This Legal Notice & Disclaimer applies to the website, products, artwork, designs, photographs, digital content, custom printing services, embroidery services, and other services provided by SJ Custom Apparels LLC (“SJ Custom Apparels,” “we,” “us,” or “our”).

By accessing www.sjcustomapparels.com, placing an order, submitting artwork, approving a design, or purchasing products or services from SJ Custom Apparels, you acknowledge and agree to this Legal Notice together with our Terms of Service and other applicable policies.

SJ Custom Apparels provides custom apparel, DTF printing, DTF transfers and gang sheets, embroidery, personalized merchandise, graphic preparation, and related services.

SJ Custom Apparels makes reasonable efforts to keep product descriptions, pricing, availability, turnaround information, photographs, and other website content accurate.

3. SJ CUSTOM APPARELS INTELLECTUAL PROPERTY

Except for customer-supplied materials and third-party intellectual property, original artwork, graphics, layouts, photographs, mockups, logos, branding, website content, marketing materials, custom design concepts, and other original materials created by or for SJ Custom Apparels may be protected by applicable copyright, trademark, and other intellectual-property laws.

Customers may not reproduce, distribute, sell, modify, publish, upload, copy, or commercially exploit SJ Custom Apparels’ protected materials without appropriate authorization.

4. PURCHASE OF A PRODUCT DOES NOT TRANSFER DESIGN OWNERSHIP

Purchasing a shirt, transfer, embroidered product, custom item, or other finished product does not automatically transfer ownership of SJ Custom Apparels’ underlying artwork, source files, editable files, embroidery digitizing files, production files, or original design concepts.

Any transfer or license of such rights must be specifically agreed to in writing.

5. CUSTOMER-SUBMITTED ARTWORK

SJ Custom Apparels allows customers to submit artwork, photographs, logos, names, graphics, and other materials for custom production.

By submitting content to SJ Custom Apparels, the customer represents that they own the material or otherwise have sufficient permission or legal authority for SJ Custom Apparels to reproduce it as requested.

SJ Custom Apparels’ acceptance of customer-supplied artwork does not constitute a determination that the customer owns the intellectual-property rights to that material.

6. COPYRIGHT & TRADEMARK RESPONSIBILITY

Customers are responsible for obtaining any licenses, permissions, releases, or other authorization necessary to reproduce protected material they provide or specifically request.

This may include:

  • Business logos
  • School or university logos
  • Sports team logos
  • Organization logos
  • Photographs
  • Artwork
  • Characters
  • Music-related graphics
  • Brand names
  • Trademarks
  • Copyrighted designs
  • Celebrity images
  • Other protected material

SJ Custom Apparels reserves the right to refuse an order when we reasonably believe the requested reproduction may violate applicable law or third-party rights.

7. CUSTOMER INDEMNIFICATION

To the extent permitted by applicable law, a customer submitting or requesting third-party material agrees to be responsible for third-party claims arising from the customer’s lack of authorization to reproduce that material.

This provision does not apply to infringement caused independently by SJ Custom Apparels without direction or material supplied by the customer.

8. SCHOOL, TEAM, UNIVERSITY & ORGANIZATION DESIGNS

The appearance of a school name, mascot, team name, university, organization, logo, trademark, or similar identifier on a custom product does not necessarily indicate that SJ Custom Apparels is affiliated with, sponsored by, endorsed by, or officially licensed by that organization.

Where authorization or licensing is legally required, the customer is responsible for obtaining the necessary permission unless SJ Custom Apparels expressly states that it holds the applicable authorization or license.

9. THIRD-PARTY TRADEMARKS

All third-party trademarks, service marks, business names, logos, characters, and other intellectual property remain the property of their respective owners.

References to third-party brands or products do not imply endorsement, sponsorship, partnership, or affiliation unless expressly stated.

10. PRODUCT MOCKUPS

Digital mockups are intended to provide a reasonable visual representation of a finished product.

A mockup is not necessarily an exact-scale manufacturing specification unless specifically identified as such.

The final product may have reasonable differences in:

  • Print positioning
  • Print dimensions
  • Garment shade
  • Thread appearance
  • Color
  • Texture
  • Embroidery positioning
  • Other characteristics inherent to custom production

11. SCREEN & PRINT COLORS

Colors displayed electronically vary depending on screen calibration, brightness, device settings, artwork color profiles, and other factors.

Digital previews therefore cannot guarantee an exact physical color match.

Reasonable color variations are not considered defects.

12. WEBSITE PHOTOGRAPHS

Product photographs and examples are provided for reference.

Garment manufacturers may make changes to products, colors, materials, construction, or specifications without notice.

Actual products may therefore vary slightly from website photographs.

13. DESIGN APPROVAL

When SJ Custom Apparels provides a proof or mockup, customers are responsible for reviewing it before approval.

Approval indicates acceptance of visible elements including spelling, names, numbers, dates, colors, layout, and design content.

SJ Custom Apparels is not responsible for customer-approved errors that were reasonably visible in the approved proof.

14. WEBSITE AVAILABILITY

We do not guarantee that www.sjcustomapparels.com will operate continuously or without interruption.

Temporary interruptions may occur because of maintenance, hosting issues, internet outages, third-party service interruptions, software updates, security issues, or other technical circumstances.

16. PAYMENT & FINANCING PROVIDERS

Approval, payment schedules, financing terms, eligibility, fees, disputes, and account decisions associated with those services are controlled by the applicable provider.

SJ Custom Apparels does not guarantee approval for third-party financing or payment programs.

17. PRODUCT USE & CARE

Customers are responsible for using and caring for purchased products appropriately.

Customers should follow garment and decoration care instructions.

SJ Custom Apparels is not responsible for damage resulting from misuse, improper washing, excessive heat, bleach, improper drying, ironing directly over decorated areas, or other improper care.

18. DTF TRANSFERS APPLIED BY CUSTOMERS

Customers purchasing DTF transfers for self-application are responsible for the application process.

Heat presses and garments can vary substantially.

Customers should verify their equipment and perform testing when appropriate.

Transfer failures caused by incorrect time, temperature, pressure, peeling, garment compatibility, press calibration, or application procedures are not considered SJ Custom Apparels production defects.

19. NO GUARANTEE OF BUSINESS RESULTS

Information concerning apparel decoration, printing, DTF transfers, embroidery, or related business practices is provided for general informational purposes.

SJ Custom Apparels does not guarantee that purchasing our products or following general information we provide will produce any particular financial, business, resale, or commercial result.

20. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, SJ Custom Apparels LLC will not be responsible for indirect, incidental, special, exemplary, punitive, or consequential damages resulting from use of the website, products, or services.

For claims directly relating to a particular purchase, our aggregate liability will not exceed the amount paid to SJ Custom Apparels for the affected product or service, except where applicable law provides otherwise.

Nothing in this Legal Notice is intended to waive or limit a consumer right or remedy that cannot legally be waived or limited.

21. FRAUDULENT ORDERS & CHARGEBACKS

SJ Custom Apparels reserves the right to cancel, hold, investigate, or request additional verification for orders reasonably suspected of fraud, unauthorized payment, identity misuse, or other unlawful activity.

Customers should contact SJ Custom Apparels promptly regarding legitimate billing or order concerns so that we have an opportunity to investigate and resolve them.

Nothing in this section restricts a customer’s lawful right to dispute a transaction with their card issuer, bank, payment provider, or financing provider.

22. REFUSAL OF SERVICE

SJ Custom Apparels reserves the right to refuse or cancel an order when reasonably necessary, including because of suspected fraud, abusive or threatening conduct, intellectual-property concerns, unlawful requests, production limitations, or inability to fulfill the requested service.

Any refund due following a cancellation will be handled according to the circumstances of the order, our applicable policies, and governing law.
